AMENDING ARTICLE IV. SECTION IV. Of ORDINANCE NO. 84

Planned Unit Developments (PUD’s)

 

SECTION 4.1.  Planned Unit Developments.  The purpose of this Section is to: 1) Encourage a more creative and efficient approach to the use of land in the City; 2) Allow variety in the types of environment available to people of the City; 3) Encourage more open space through the distribution of overall density of population and intensity of land use where such arrangement is desirable and feasible; and 4) Provide the means for greater creativity and flexibility in environmental design than is provided under the strict application of the provision of the Avon Zoning Ordinance and the Avon Subdivision Ordinance while at the same time preserving the health, safety, order, convenience, prosperity, and general welfare of the City and its inhabitants.

 

SECTION 4.2 Zoning District Supplement.  The Planned Unit Development (PUD) designation is supplementary to the zoning classification, and more than one zoning designation can be included under the PUD designation. Additionally, the PUD designation shall be assigned in the same manner as a zoning classification and shall be designated in the legal description of the original district(s) being supplemented.

 

SECTION 4.3  Application.  An applicant for a PUD shall submit in the application all of the material required by the Avon Zoning Ordinance for a rezoning.  If land encompassed within the PUD is to be subdivided, an application shall be made through the subdivision process established in the Avon Subdivision Ordinance.

 

SECTION 4.4  Additional Requirements.

 

A.  Minimum Lot Size. The area included in a PUD shall consist of not less than three acres of contiguous land.

 

B.  Density. The underlying zoning designation(s) shall serve as the criterion to determine the maximum dwelling unit density of the total development. With the exception of those areas regulated by shore land density requirements, the City may authorize a dwelling unit density up to 10% greater than allowed in the underlying zone if the City determines that the proposed PUD accomplishes the purposes outlined in Section 4.1(3) and 4.1(4) above, and is consistent with the comprehensive plan for the City.

 

C.   Set-back and Side Yard Requirements.  Notwithstanding other provisions relating to PUD's, every yard abutting the perimeter of a PUD shall conform to yard requirements for the underlying district.

 

This Ordinance was adopted the 11th day of April 2005, and shall be effective upon publication.
