ORDINANCE NO. 150
AN ORDINANCE AMENDING ORDINANCE NO. 84, REZONING CERTAIN REAL PROPERTY LOCATED WITHIN THE CITY OF AVON, STEARNS COUNTY, MINNESOTA
WHEREAS, a petition has been submitted to the city of Avon requesting the rezoning of Lots 2, and 3, Block 3 of D.H. Blattner and Sons addition to the City of Avon from an R1 (Single Family Residential) designation to C2 (General Commercial) designation;
WHEREAS, Minnesota Statutes Chapter 462 at Section 462.357 (4) authorizes the Avon City Council to amend the City’s Zoning Ordinance upon its own motion;
WHEREAS, the City Council has caused Notice of a Public Hearing to be published in the City’s Official Newspaper and has notified all property owners within 350 feet of the property at least ten (10) days prior to the public hearing at which the proposed rezoning was set for consideration;
WHEREAS, the subject real property is legally described as
Lots 2 and 3 of Block 3 of
D.H. Blattner and Sons Addition to the City of Avon,
And generally shown as the shaded area on the map which is attached hereto and made a part of this Ordinance;
WHEREAS, rezoning the subject real property is necessary to permit the development of commercial and other uses specified under the City’s Zoning Ordinance;
WHEREAS, the Avon City Council held a public hearing on September 2nd, 2003, to consider the proposed rezoning at which time all persons wishing to be heard on this matter were given an opportunity to state their concerns;
WHEREAS, the City Council of the City of Avon finds that the rezoning of Lots 2 and 3 all in Block 3 of D.H. Blattner and Sons Addition to the City of Avon is in compliance and furtherance of the City’s existing comprehensive plan and is in the best interest of the property owners, surrounding residents and the public in general; further finding that the change in zone will not have an adverse impact on surrounding property and the health, safety, and welfare of the residents in the community; and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AVON, STEARNS COUNTY, MINNESOTA DOES HEREBY ORDAIN:
That Ordinance No. 84 be amended by designating Lots 2 and 3 of Block 3 of D.H. Blattner and Sons Addition to the City of Avon, as set out on the attached map, as a C-2 zone for land use purposes.
This Ordinance shall become effective from and after its passage and publication.
Adopted by the unanimous vote of the Avon City Council this 2nd day of September 2003.
