ORDINANCE NO. 147

 

REPEALING ORDINANCE NO.  31 AND

REGARDING CURFEW WITHIN THE CITY OF AVON

 

 

SECTION 1:  It shall be unlawful for any boy or girl of the age of fifteen years or under, between the hours from 10:00 P.M. to 6:00 A.M., or for a boy or girl of the age of sixteen or seventeen years between the hours from 12:00 A.M. to 6:00 A.M., to be abroad upon the streets, alleys, or public grounds of the City of Avon, unless accompanied by some person of lawful age, having him or her in charge, or unless upon some errand by permission or direction of his or her parents, guardian, or employer, in which case he or she shall not loiter on the way nor make any undue noise by shouting or yelling or otherwise to disturb the peace and quiet of the City.

 

            SECTION 2:  Parents.  It shall be unlawful for the parent, guardian, or other person having custody of a child to permit such child to violate any provision of this ordinance.

 

            SECTION 3:  Penalty.  Any minor violating any provision of Section 1 shall be dealt with in accordance with juvenile court law and procedure.  Any person, persons or corporation subject to the penalty of said ordinance by reason of violation thereof or failure to conform to said ordinance shall, upon conviction, be subject to the payment of a fine not to exceed the sum of $1,000 or imprisonment for ninety (90) days, or both.

 

            SECTION  4: This ordinance shall repeal Ordinance No. 31 Regarding Curfew.  This ordinance shall be in force from and after its passage approval and publication as provided by law.
