ORDINANCE NO. 107

 

AN ORDINANCE REPEALING AND AMENDING CERTAIN SECTIONS OF ORDINANCE NO. 61 RELATING TO THE KEEPING OF DOGS WITHIN THE CITY OF AVON:  PROVIDING FOR THE LICENSING, CARE, PROTECTION, AND DISPOSITION OF LICENSED AND UNLICENSED DOGS:  PRESCRIBING PENALTIES FOR THE VIOLATION THEREOF:

 

THE CITY COUNCIL OF THE CITY OF AVON DOES HEREBY ORDAIN THAT THE FOLLOWING SECTIONS OF ORDINANCE NO. 61 BE AMENDED AS HEREAFTER DESCRIBED:

 

1. Section 4 shall be amended to read: Section 4. Date of Payment of License Fee, License Fee $5.00.

 

"It shall be the duty of the owner of a dog required to be licensed to pay the Village Clerk the prescribing license fee on or before the 1st day of January, in each year, or upon acquiring ownership or possession of an unlicensed dog, or upon establishing residence in the Village. The Village Clerk shall cause a notice of the necessity of obtaining such license and paying such license fee to be published in the official newspaper of the Village twice before the 1st day of January in each year, the last publication to be at least one week prior to such date. When applying for a dog license, the owner shall state the name, sex, breed, and color of the dog for which the license is to be procured. At the time of the license application, the owner must provide the Village Clerk with proof that the dog has received a rabies shot or booster before a dog license will be issued".

 

2. Section 5. Receipts and Tags.  The first sentence of Section 5 shall be amended to read: "Licenses issued hereunder shall expire on the 1st day of January of the calendar year following its issuance."

 

3. Section 8. Redemption.  The last sentence of Section 8 shall be amended to read: “The amount of the redemption fee to redeem an impounded dog shall be:

a.  Per fee schedule.

 

4.  Section 17.  Kennels.  The last sentence of Section 17 shall be amended to read:  "The licenses shall expire annually on January 1st of each year."

 

5. Section 18. Penalty.  Section 18 shall be amended to read: "Any person violating any provision of this ordinance shall be guilty of a misdemeanor and upon conviction thereof, shall be punished by a fine of not more than $700.00, or by imprisonment for not more than 90 days, or both".

 

6. Section 19. Current Licenses and Tags.  Section 19 shall be amended to read: "All current licenses, if properly attached when this ordinance becomes effective, shall continue to be valid until January 1, 1990".
